A federal judge has ordered the immediate discharge of Kilmar Abrego Garcia from detention by ICE, concluding his ongoing confinement lacks legal authority.

"Since his release after wrongful imprisonment in El Salvador, he has been re-detained, again without legal justification," Judge Paula Xinis stated in her ruling.

The situation stems from a erroneous deportation to El Salvador earlier this year, which the government later admitted was an error. After his repatriation to the United States to answer alien smuggling charges, he was detained in immigration custody.

In her order, the court noted that the authorities lacks a current removal order, which effectively blocks them from removing Mr. Abrego Garcia "at this juncture."
